Terms of Service

1. Acceptance of Terms

By accessing or using ViralHighlight ("the Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. The Service is not directed at persons under 16 years of age; by registering you declare that you are at least 16 years old.

2. Description of Service

ViralHighlight is a SaaS platform offering AI-powered content generation tools for social media creators (hook generators, captions, scripts, hashtags, bios, and more). The Service is offered under a freemium model with the following plans:

  • Free Plan: 50 credits/month, access to basic tools.
  • Pro Monthly Plan: 1,500 credits/month at €49/month.
  • Pro Annual Plan: 20,000 credits/year at €480/year (€40/month).

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable prior notice.

3. Account Registration

To access the Service features you must create an account. You agree to: (a) provide truthful, accurate, and complete information during registration; (b) maintain and update such information; (c) maintain the confidentiality of your password; (d) notify us immediately of any unauthorized use of your account. You are responsible for all activities carried out under your account. Creating multiple free accounts to circumvent the free plan limits is prohibited.

4. Credits and Usage

The Service operates on a credit system. Each AI content generation consumes credits according to the type of tool used. Credits:

  • Are allocated at the start of each billing period.
  • Do not roll over between billing periods.
  • Unused credits expire at the end of the period.
  • Are non-transferable and not redeemable for cash.

5. Subscription Plans and Billing

Pro subscriptions are billed in advance on a monthly or annual basis through Stripe, our payment provider. By subscribing you authorize ViralHighlight to charge the corresponding amount to your payment method at each renewal period.

  • Prices are displayed in euros (EUR) and include applicable VAT in accordance with current regulations.
  • Subscriptions renew automatically unless you cancel before the end of the current period.
  • Prices may be modified with at least 30 days prior notice by email.
  • Failed payments may result in suspension of Pro access.

6. Cancellation and Refunds

You may cancel your subscription at any time from your account settings or by contacting legal@viralhighlight.com. Cancellation takes effect at the end of the current billing period; you will retain Pro access until that date.

Refund policy: We offer a full refund within 14 calendar days of the first subscription or a renewal, provided you have not consumed more than 10% of the credits allocated in that period. Requests outside this window are not eligible for a refund. To request a refund, contact legal@viralhighlight.com with your registration email and reason.

Refunds do not apply to partial billing periods or to additional credits purchased outside of the subscription.

7. AI-Generated Content

Content generated by our AI tools is provided "as is" without warranties of accuracy, originality, fitness for a particular purpose, or non-infringement of third-party rights. The user is solely responsible for reviewing, editing, and verifying the content before publishing it.

  • ViralHighlight does not claim ownership of the content you generate.
  • The prompts and inputs you submit are processed by third-party APIs (OpenAI, Groq) subject to their own policies.
  • Do not use the Service to generate illegal, defamatory, fraudulent, or copyright-infringing content.

8. Acceptable Use Policy

The following are strictly prohibited:

  • Using the Service to generate mass spam, phishing, disinformation, or content that violates third-party rights.
  • Attempting to reverse-engineer, decompile, or disassemble any part of the platform.
  • Reselling, sublicensing, or distributing the Service or generated content for commercial purposes without express authorization.
  • Automating requests to the Service in a manner that exceeds credit limits or overloads the infrastructure.
  • Creating multiple free accounts to circumvent the free plan limits.
  • Using the Service for illegal activities or activities that may cause harm to third parties.

Violation of this policy may result in the immediate suspension or termination of your account without refund.

9. Third-Party Services

The Service integrates the following third-party providers, whose terms and privacy policies apply independently from these:

  • Stripe — payment processing (stripe.com/legal)
  • Google — OAuth authentication (policies.google.com)
  • OpenAI / Groq — AI content generation (openai.com/policies, groq.com/privacy)
  • Vercel — hosting and analytics (vercel.com/legal)
  • Sentry — error monitoring (sentry.io/privacy)

ViralHighlight is not responsible for the services, content, or privacy practices of these third parties.

10. Intellectual Property

The ViralHighlight platform, including its design, source code, brand, logos, and original materials, is the property of its owners and protected by applicable intellectual property law. The AI models used are the property of their respective providers (OpenAI, Groq). The content you generate using the Service is yours; we claim no rights over it.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL BE ACCURATE, ORIGINAL, OR NON-INFRINGING. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRALHIGHLIGHT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. VIRALHIGHLIGHT'S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE USER IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR €50 IF NO PAYMENT HAS BEEN MADE.

13. Indemnification

You agree to indemnify, defend, and hold harmless ViralHighlight and its employees, officers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) content you publish using the Service; (c) violation of these Terms; or (d) infringement of third-party rights.

14. Termination

We may suspend or terminate your access to the Service immediately, without prior notice, if you violate these Terms or for any other justified reason. Users may close their account at any time from their profile settings or by contacting legal@viralhighlight.com. After termination, data is retained and deleted in accordance with our Privacy Policy. Provisions that by their nature should survive termination (limitation of liability, indemnification, governing law) shall remain in force.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with Spanish law and European Union legislation. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of Spain.

For consumers in the European Union, the EU Online Dispute Resolution Platform is available at: ec.europa.eu/consumers/odr.

16. Changes to Terms

We may update these Terms periodically. We will notify you of material changes by email at least 30 days before the effective date. Continued use of the Service after that date constitutes acceptance of the new terms. If you do not agree with the changes, you must cancel your subscription and stop using the Service before the effective date.
